If you’ve recently received a traffic ticket Raleigh, or a traffic infraction Raleigh, it’s important that you handle this as promptly and efficiently as possible. Why?

Because your failure to handle the matter may result in a Failure to Appear (FTA) which will be communicated by the Raleigh courts to the North Carolina DMV. This will result in a suspension of your license, if not properly corrected.

In addition, if you drive while on a suspended or revoked license, and get a second ticket you will face an additional license suspension. I’ve encountered plenty of people who believed they had paid their fee by mailing it into the court, only to find that the fee was not entered properly, or never received, or the amount they sent in to the court was not correct.

In all these cases, DMV suspended the license, but folks were not properly notified. No matter. The license was suspended. Perhaps they got a second traffic violation. This resulted in a further suspension of their license. And the nightmare begins, of dealing with the courts and the North Carolina Department of Motor Vehicles.

Even if the matter is a simple speeding ticket, you should be sure to pay the ticket yourself, or have a lawyer pay it on your behalf. Do not simply send the payment in with the ticket.

And if it’s a speeding ticket where you were accused of exceeding the speed limit by more than 15 mph, you should be careful about handling this yourself. That’s because that high a speeding ticket is a misdemeanor, which results in an automatic suspension of your license for a month. If you can get a reduced speeding ticket by negotiating with the DA, or request a PJC, that is a much better option.

A Domestic Violence crime is specially handled in Wake County, North Carolina. A domestic violence crime may involve a charge of simple assault, assault on a female (AOF), communicating threats, or interfering with emergency communications. It may also include damage to personal property, and even more serious charges. If you are charged with a domestic violence crime in Raleigh, you certainly need to talk to a competent and understanding domestic violence lawyer Raleigh.

That’s because these cases are generally handled in a special courtroom, where special practices are used. In addition, because Domestic Violence cases involve special pre-trial release rules, you may be held in custody for an entire weekend or more before you are released.

In addition, it’s important that at the time you appear at your First Appearance hearing you have an attorney present. That’s because you want to make sure you are released on as few conditions as possible. And, if there are children involved, you want to make sure that any “no contact” orders allow you to remain involved with your children.

In addition, there may be other aspects to your case – including a divorce, pending divorce, property disputes, or a civil 50B protective order – that you need to have handled. By hiring a lawyer who can look out for all your interest, you can ensure that your case is properly handled with as few problems as possible.

Finally, if you are a man and accused of striking a woman, you will be charged with an Assault on a Female. An assault on a female conviction means that you may never possess a gun or ammunition again in your life. If you hunt, this will have life-changing implications for you.

Make sure that you consult with a Raleigh lawyer about these very serious charges.

Whether you’ve been charged with having drugs Raleigh at a Widespread Panic concert, prescription drugs unlawfully in your home or dorm room, or you’ve been charged with trafficking in 500 pounds of marijuana or 6 kilos of cocaine, Raleigh drug charges can result in serious consequences for you and your family.

If this is your first time offense, and there is no good defense to the charges, and the amount of drugs is small, you may be eligible for a felony drug diversion or misdemeanor drug diversion (90-96) program. These programs are offered by the Wake County District Attorney and administered through Southlight, an addiction treatment program in Wake County.

You should hire a competent, qualified Raleigh drugs lawyer to make sure that at every step in the process your rights are protected, and that, if you successfully complete the program, the charges and record of the arrest can be wiped clean (expunged) from your record.

If you’ve been charged with drug manufacturing, selling drugs, possession with intent to sell and deliver (PWISD), maintaining a dwelling, or drug trafficking crime, you absolutely need an aggressive, thorough North Carolina drug lawyer who can help defend you.

That’s because crimes involving drug sales, or possession with intent to sell are felonies, which can result in serious consequences, especially when it comes to your future employment, your ability to remain out of jail, and other aspects important in your life.

And if you’ve been charged with drug trafficking, you need to talk to a lawyer who understands how both the state drug trafficking laws work and also how to defend you in federal court. That’s because the federal government – through the United States Attorney for the Eastern District of North Carolina (EDNC) – will frequently take cases “federal,” which can result in substantially harsher sentences.

It is important, whether the drugs are heroin, ecstacy, cocaine, oxycodone, oxycontin, marijuana, meth, methamphetamines or other kinds of drugs that you or your family get the advice of a serious drug lawyer Raleigh to help defend you against these charges.

A larceny is a type of theft. There are various types of theft in North Carolina – Embezzlement, Obtaining Property by False Pretenses, and Larcenies. In addition, there are various kinds of frauds. Sometimes the distinction between a fraud and a theft is hard to make out.

Larcenies – unlike Obtaining Property by False Pretenses and Embezzlements – can be either misdemeanors or felonies.

A larceny in Raleigh will typically be a misdemeanor if the value of the item in question is $1,000 or less.

However, a larceny can be a felony if the item is valued at $1,000 or more, or the item was taken from the person.

Those charged with misdemeanor larcenies in Raleigh for whom this is the first offense may be eligible for a first offenders or deferral program, where if they comply with the program, they would have the charges dismissed after 6 months or a year.

Those charged with misdemeanor larcenies who do not qualify for a deferral or first offenders program will need to fight the case on the merits. If this is a case involving shoplifting, and if the store does not send a representative, the case may be eventually dismissed, although you run the risk that if the representative does appear, you could be convicted.

Prison Rates in the United States

In the United States we like to think we’re a free and peace loving country, and that may be true. But the United States consistently has some of the highest incarceration rates in the world. Is this because Americans are more criminal than other people? Probably not.

This may be because 40 years of a drug war has done a great deal to weaken protections for criminal defendants – who should be presumed innocent – and led to the incarceration of millions of human beings for drug use, drug sales, and drug trafficking.

Here are some heart-breaking charts that make this point.

Drunk Driving in Raleigh the Day After

Interesting article about the World Cup and the increase in drunk driving charges worldwide. One common problem is that a night of heavy drinking and partying can result in someone being still impaired the next morning. I’ve handled countless cases where clients awoke the next morning still impaired at well above a BAC of .08.

Studies in Europe show that 51 per cent of drivers have unintentionally driven the morning after while still being over the legal blood alcohol limit. With the first England group match happening tomorrow, the company has put together a short guide to help fans avoid “doing a Ferdinand.” Our local hostelries will be heaving with local soccer fans for the duration of the tournament until July 11. So, it seems to me this advice should be offered for “consumption” here.

In these tough economic times, embezzlement has become a crime more frequently prosecuted by either the state or federal prosecutors in North Carolina.

That’s because either employees have been taking money from employers to make ends meet, or employers are accusing innocent employees because employers want to stop “shrinkage” or the loss of money or merchandise that is not the employees’ fault.

Each embezzlement case is unique. Whether you are facing an embezzlement charge in Wake County, or in the Eastern District of North Carolina (federal court), you need a lawyer who knows how to work in both the state and federal courts.

North Carolina’s criminal code describes the crime of embezzlement, which is a form of theft.

Embezzlement may be:

* property received by virtue of office or employment
* state property by public officers and employees
* funds by public officers and trustees
* by an officer of a railroad company
* or by a surviving partner of a business partnership
* or may be defined under Federal Embezzlement Laws

The U.S. Code, Title 18 lists the many provisions of federal embezzlement lawsystem.

Under state law, embezzlement may be either a Class H felony (which is a fairly low level felony) or, if above $100,000 in value, a Class C felony (which is a fairly serious felony).

A Wake County district attorney or federal United States Attorney must prove that the defendant – you – had the intent at the time of the incident to embezzle or that you knowingly and willfully converted money (or any other kind of property) to your own use

Damon Chetson has experience in both state and federal courts. He has represented people accused of everything from drunk driving and driving while impaired, to people accused of drug trafficking and rape. He has also resolved many embezzlement cases before they reach the charging and arrest stage by negotiation resolutions with employers to avoid arrest.

Avoiding prosecution for embezzlement is one of the things I do as part of my practice as a criminal lawyer in Raleigh. I deal with clients who either have left an employer and have been accused of stealing from the employer, or have been accused of stealing and have been fired. In either case, I can help you avoid prosecution for the felony embezzlement.

One of the ways I do this is to enter into a negotiation with the employer to find out why they think you may be responsible for the embezzlement. If the employer is simply fishing and has no real reason to blame you, then I certainly would recommend you enter into an agreement with them that results in your paying them for the loss.

But if your acts – either criminal or through negligence – have led to a loss for the company, then your best option may be to reimburse the employer for the loss, thus avoiding a criminal charge and conviction.

Why would you want to do this? First, a criminal charge, even if it never results in a conviction, can really destroy your life. It can place strain on your marriage, and make it very difficult for you to find new employment.

For that reason, it may be worth your while to reimburse the former employer, even if you weren’t criminally liable for the loss.

Second, a criminal charge may result in a trial, which will cost you many thousands of dollars in legal fees, and the potential of a conviction.

To save you both the time and the money of defending against a criminal charge, I can work with you and negotiate on your behalf with the former employer to make sure that you escape criminal liability.

In many cases, I’m able to negotiate an agreement that means that the former employer will never give you a bad reference or speak negatively about you. This can help you a great deal in finding future employment.

I can do all of this at a fraction of the cost it would be to hire me to defend the criminal case at trial.

Oprah Winfrey recently launched a campaign to have celebrities pledge not to text while drive. Doctors now assert that driving while texting may be as dangerous as driving while impaired.

The problem with enforcing a driving while texting law is that, unlike a driving while impaired law, texting leaves no lingering effects. In other words, you have to catch the texting in the act.
